Terms of Service

These Terms govern access to Digital Tactical Worksheets (DTW), including worksheets, instructor workspaces, scenario tools, demonstrations, and related services provided by Digital Tactical Solutions, LLC ("DTW," "we," or "us"). By accepting these Terms or using the service, you agree to them. If you act for an organization, you must have authority to bind it. A separately signed agreement controls if it conflicts with these Terms.
1. Eligibility and accounts
Account holders must be at least 18 and legally able to enter this agreement. Keep credentials and room, presentation, and access codes secure. Use your own instructor account and stay within the users, seats, and uses covered by your plan. You are responsible for activity you authorize and for promptly reporting suspected unauthorized access. Creating an account alone does not activate paid training tools.
2. Authorized and responsible use
Use DTW lawfully and within your training, qualifications, and agency authorization. Do not bypass access controls, share paid access outside your plan, disrupt the service, introduce malicious software, impersonate others, or upload unlawful or infringing material. You must have permission to use uploaded photos, maps, audio, personal information, and other content, including any required recording consent. Do not upload patient identifiers, protected health information, classified information, or other regulated sensitive data unless DTW has separately agreed in writing to the required protections.
3. Training, simulations, and demonstrations
Instructors are responsible for exercise design, participant supervision, appropriate safety controls, and evaluation. Simulated fire, smoke, timing, unit status, and candidate results are illustrative; they do not predict actual conditions or establish competency, certification, standards compliance, or fitness for duty. Starter buildings are illustrative training assets. The public Scenario Builder exploration mode cannot save scenarios; its photos and edits are temporary and are lost when the page is closed or reloaded.
4. Subscriptions, renewal, and cancellation
DTW Instructor is offered at US $49 per month or US $499 per year, plus any applicable taxes. Your selected interval, price, and any applicable taxes are shown before payment. Paid subscriptions renew automatically and charge the payment method on file each billing period until canceled. Complimentary access lasts for the period granted and does not by itself authorize a charge.
Cancel before your next renewal through Plans & Billing → Manage Billing in Stripe. If you cannot access cancellation, contact contact@digitaltacticalworksheets.com. Cancellation stops future renewals; access normally continues through the paid period. Deleting browser data, stopping use, or requesting account deletion does not itself cancel a subscription. Unless required by law or a separate written agreement, partial periods are not automatically refunded. Contact us about billing mistakes or refund requests. Department and enterprise pricing, invoicing, and purchasing conditions are specified in their order or written agreement.
We will notify affected subscribers of material price or renewal changes before they take effect, as required by law, so they can cancel before being charged the changed amount. Failed or overdue payments may suspend paid features. Payment processing is provided by Stripe under its applicable terms.
5. Content, ownership, and records
You retain your rights in content you submit. You grant DTW permission to host, copy, process, and display that content as needed to operate, secure, and support the service and to share it with participants you authorize. DTW and its licensors retain rights in the software, design, branding, and supplied assets. Your plan grants a limited, nonexclusive right to use them through the service; it does not transfer ownership or authorize resale.
Keep independent copies of records you need. Browser storage, exports, incident snapshots, and training records are not guaranteed archives or official agency records. You and your organization remain responsible for retention, public-records obligations, disclosure, and verification of any record used for operational, personnel, or legal purposes. 6. Availability and changes
Features may depend on power, device capability, browser permissions, network connectivity, and third-party services. Availability, synchronization, accuracy, and recovery are not guaranteed. We may maintain or change features and may suspend access for nonpayment, misuse, security threats, or legal requirements. We will provide notice when reasonably practicable. Before closing your account, export needed content and cancel paid renewals. Mandatory rights and separately agreed service commitments remain unaffected.
7. Warranty disclaimer and responsibility
To the fullest extent permitted by law, the service and its outputs are provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted service, or error-free results. DTW does not warrant that use will prevent injury, loss, or an adverse incident outcome. You remain responsible for evaluating whether the service is appropriate for each use and for independently verifying information.
8. Limitation of liability
To the fullest extent permitted by applicable law, DTW and its licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, business, or data arising from the service. To that same extent, aggregate liability arising from the service is limited to the amounts you paid DTW for the affected service in the 12 months before the event giving rise to the claim. These limitations do not exclude liability or remedies that cannot legally be excluded, including any applicable protections for personal injury, fraud, gross negligence, or willful misconduct. Any separately signed agreement governs to the extent it provides different limits.
9. Changes, questions, and disputes
The version date identifies the current Terms. We will give reasonable notice of material changes and obtain renewed agreement where required. Changes do not retroactively remove accrued rights. If a provision is unenforceable, the remaining provisions continue to apply. Nothing here waives protections that apply to you by law or an agency's rights under a signed agreement. Please contact us first about a concern so we can try to resolve it.
